Terms and Conditions: House Sitting & Pet Walking and Drop-In Visits
All Pets At Your Home
1. A minimum deposit of 50% of the total cost of House Sitting is due at the time of initial consultation and the remaining 50% is to be paid at time of first visit and left in conspicuous place for pet sitter. A finance charge of 20% per month will be added to unpaid balances after (30) thirty days. A handling fee of $50.00 or ½ the total amount of the check (whichever is greater) will be added to all returned checks. Checks are to be made payable to HOTEL K, LLC. (“HOTEL K”)
2. Holidays – require a full payment of services at time of consultation. Additional $10 per day fee for each Holiday (New Year's Eve and New Year's Day, Memorial Day, July 4th, Labor Day, Thanksgiving, Christmas Eve and Christmas Day).
3. House Sitting Refund & Cancellation Policy –
a. If Owner plans to shorten their trip and arrive home early, they must give the Pet Sitter a minimum of 6 hours notice of early arrival. If Owner cancels their trip early and once the contract start date/time has started, no refund will be issued and the full cost of the contract will be charged to the Owner.
b. No refunds will be given to cancellations within 48 hours of the start of the contract. (Forfeit security deposit)
c. No Refunds will be given to cancellations within 72 hours of the start of the contract that include US National Holidays noted on Service Agreement.
d. A 50% Refund will be issued to the Owner if canceled within 5 Days of the start of this contract. If reservations are canceled 5 days or more before the start of the contract a full refund will be issued.
e. Any refunds will be paid to the Owner by Hotel K within 30 days of the last day of this contract.
4. Dog Walking and Cat & Small Caged Drop-in Refund & Cancellation Policy –
a. Owner must cancel 4 Hours BEFORE the scheduled Drop-In time. If Owner cancels within 4 hours of scheduled Drop-In time, then the full price of the service for that day will be charged. This applies to each day that has a reservation.
5. The Owner gives full authorization to Hotel K to enter the Owner’s property during the dates/times agreed on in this contract.
6. The Owner will give two sets of keys and/or codes to enter the property. If in the event Hotel K, their staff or volunteers loose or misplace any keys or codes to the Owners Property, the Owner agrees to not hold Hotel K, their staff or volunteers responsible and the Owner will waive any cost of replacing keys or rekeying the property unless gross negligence or willful misconduct on the part of Pet Sitter is proven.
7. If Owner plans to lengthen their trip they must telephone Pet Sitter a minimum of 12 hours in advance of the last Pet Sit in order to be put back on Pet Sitters schedule. Owner agrees to pay all additional fees incurred promptly upon their return.
8. Owner must telephone Pet Sitter PROMPTLY upon their returning home and leave a message in order not to incur another Pet Sitting charge.
9. Owner will inform their Veterinarian that a Pet Sitting Service will be caring for their pet(s) in their absence. If possible Owner will make arrangements to have Veterinarian reimbursed for any service necessary during their absence by leaving their credit card number on file.
10. I further understand and agree in leaving my pet(s) in the care of Hotel K has relied on my representation that my pet(s) is/are in good health and have not harmed or shown aggression or threatening behavior towards any person or any other pet(s).
11. I further understand and agree that Hotel K and their staff and volunteers will not be liable for any problems that develop provided reasonable care and precautions are followed. I hereby release Hotel K, their staff, and volunteers of any liability of any kind whatsoever arising from my pet(s) attendance and participation at Hotel K.
12. I further understand and agree that any problem that develops with my dog(s) will be treated as deemed best by the staff at Hotel K, LLC, in their sole discretion, and that I will assume full financial responsibility for any and all expenses involved. I authorize Hotel K, LLC to obtain medical records and/or treatments for my dog(s) in the event of injury or illness from my veterinarian or from the closest veterinary clinic/ hospital. By signing this document I further direct said veterinarian to provide such records upon request. I also direct said veterinarian to perform any needed emergency care for my dog(s) and ask that the veterinarian bill me directly.
13. I further understand that my dog(s) may experience minor cuts, scratches, and abrasions due to the nature of dog play.
14. Hotel K, their staff, and their volunteers are not veterinarians and will not advise any client on medical issues. If there are questions, Hotel K staff will assist clients in obtaining answers through professional veterinarians only.
15. Hotel K reserves that right to refuse service to any pet with or without reason at any time.
16. I allow my pet(s) to be photographed, videotaped, and/or used in any media or advertising without prior approval from me. All such photographs, etc are the property of Hotel K and use of any pictures, etc in media shall not incur any use or licensing fees paid to other by Hotel K.
17. In the unlikely event of illness or personal emergency to Pet Sitter, Owner will authorize Pet Sitter to arrange for another qualified person to fulfill responsibilities as set forth in this contract. Owner will be notified in such a case.
18. It is the Owners responsibility to make sure all of their pet(s) are current on their vaccinations. Should the Pet Sitter be bitten or otherwise injured by the Owner's pet(s), the Owner agrees to pay all medical costs and lost wages incurred by Pet Sitter due to such injury.
19. Owner is responsible for any injury caused to Pet Sitter or the general public by Owner’s pet(s) or condition of Owner’s premises.
20. In the event of inclement weather or natural disaster Pet Sitter will use their best judgment in caring for Owners pet(s) and home but cannot be held responsible for any damage to home or injury to pet arising from such.
21. If a problem arises such as a pipe rupture, flooding, earthquake, fire, break in, animal destroying fence etc., Pet Sitter will make every effort to contact Owner and follow their instructions. If Owner cannot be reached or immediate action is necessary for the health, safety and welfare of the pet(s), Owner authorizes Pet Sitter to make any repairs deemed necessary by the Pet Sitter. The Owner agrees to reimburse Pet Sitter for all expenses incurred for repair of property and will hold Pet Sitter blameless for work done by others.
22. Owner is to notify Pet Sitter if anyone else has keys or access to Owner’s property other than Pet Sitter during the time the Pet Sitter is caring for Owner’s home and pet(s). Pet Sitter cannot be held liable for damage done to home and pet(s) by others with such access. In addition, Pet Sitter shall not be held liable for damage done by pet to either the interior or exterior of home when Pet Sitter is not there.
23. Pet Sitter is not liable for pets that are left outside or may escape when Pet Sitter is not in attendance.
24. Owner shall, at Owner's sole expense, defend Pet Sitter against any claim or demand, whether or not well founded arising from any act(s) of Owner’s pet(s) or relation to Owner’s property. Owner shall indemnify and hold Pet Sitter free and harmless from all cost, expenses and liabilities in connection with such claims or demands. These costs, expenses and liabilities include amounts paid in settlement before or after suit is commenced, attorney’s fees and costs incurred by Pet Sitter in defending against such claims or demands.
25. Pet Sitter will provide the services stated herein in a reliable, caring and trustworthy manner. In consideration of these services and as an express condition thereof, Owner expressly waives and relinquishes any and all claims against Pet Sitter except those arising from gross negligence or willful misconduct on the part of Pet Sitter.
26. Should any section, provision or portion of the contract be held to be invalid, illegal, void or unenforceable, then such section, provision or portion shall be deleted from this contract. The remainder of this contract shall continue in full force and effect.
27. Any controversy or claim arising out of or in relation to this contract shall be brought to Small Claims Court before any other action is taken. If the matter cannot be resolved in Small Claims Court then the parties agree to binding Arbitration in accordance with the State where is was signed. The arbitrator shall be based on the rules of the American Arbitration Association.
28. This contract shall be interpreted and governed by the laws of the State in which it is signed. Each party will perform its obligations in accordance with all the applicable laws, rules and regulations of said State.
29. No term or provision of this contract shall be waived and no breach excused verbally. To be effective, each waiver or excuse shall be in writing and signed by the party who waived or excused.
30. Each waiver or excuse shall be independent of all other. Therefore, if a term or provision is waived or breach is excused, that waiver or excuse shall not waive any other term or provision or excuse any other breach.
31. In no event will Pet Sitter be liable to Owner for any damages, including, but not limited to any lost profits, lost savings or their incidental or consequential damages arising out of Owners use of Pet Sitter services, nor will Pet Sitter be liable for any claim by any third party, unless gross negligence or willful misconduct is proven on the part of the Pet Sitter.
32. Pet Sitter reserves the right to terminate this contract at any time before or during its term if Pet Sitter, in their sole discretion, determines that Owner’s Pet(s) pose a danger to the health and/or safety of Pet Sitter. The home must be in sanitary conditions for the pets and the sitters at all times. If this occurs Pet Sitter will notify the Owner immediately of the problem and determine whether Owner will return or if pet(s) will need to be placed in a kennel with all charges to be charged to the Owner.
33. Owner authorizes this signed contract to be valid approval for future services of any purposes provided by this contract permitting Pet Sitter to accept telephone reservations for service and to enter the premises without additional signed contracts or written authorization.
34. I understand that all pet food, specific pet treats, medications, and everyday pet supplies are provided by me, the pet owner for the whole entire length of House Sitting or Pet Drop-In. If Hotel K is required to supply pet food, medications and/or pet supplies, the cost of the pet food, medications and pet supplies plus $20.00/per shopping trip will be charged to me.
Terms and Conditions: Daycare and Overnight Stays at Hotel K (Dogs Only)
1. There is a 24 hour cancellation policy for daycare reservations. If I do not cancel a daycare reservation with at least 24 hours notice, I will be charged one full day of daycare.
2. There is a 48 hour cancellation policy for overnight reservations. If I do not cancel an Overnight Stay Reservation with at least 48 hours notice, I understand that I will forfeit the security deposit paid at the time of booking.
3. There is a deposit of at least 50% of total cost for all reservations. Deposit is due when Service Agreement is signed.
4. I understand that full payment is due at the start date of services by Hotel K LLC . I understand that a fee of $60.00 will be charged for returned checks unpaid to Hotel K.
5. I understand that I am solely responsible for any harm caused by my dog(s) while my dog(s) is/are attending Hotel K for Daycare or Overnights.
6. I further understand and agree in admitting to my dog(s) that Hotel K has relied on my representation that my dog(s) is/are in good health and have not harmed or shown aggression or threatening behavior towards any person or any other dog.
7. I further understand and agree that Hotel K and their staff and volunteers will not be liable for any problems that develop provided reasonable care and precautions are followed. I hereby release Hotel K, their staff, and volunteers of any liability of any kind whatsoever arising from my dog(s) attendance and participation at Hotel K.

I further understand that if I fail to provide proof of current vaccinations or if my dog(s) vaccinations are found to be expired or otherwise incomplete, Hotel K has the right to refuse service until current proof is provided. If my dog(s) arrives at the facility with fleas and/or other parasites, Hotel K, has the right to quarantine my dog(s) until picked up by myself or my agent, and I take full responsibility for any expenses incurred for such reasons.
10. I further understand that my dog(s) may experience minor cuts, scratches, and abrasions due to the nature of dog pay.
11. Hotel K, their staff and their volunteers are not veterinarians and will not advise any client on medical issues. If there are questions, Hotel K staff will assist clients in obtaining answers through professional veterinarians only.
12. Hotel K reserves that right to refuse service to any dog with or without reason at any time.

If Hotel K is required to supply pet food, medications and/or pet supplies, the cost of the pet food, medications and pet supplies plus $20.00/per shopping trip will be charged to me.
15. Abandoned dog policy: If I bring my dog to Hotel K and abandon the dog, Hotel K will notify the proper local authorities including Madison Police Dept and the Dane County Humane Society and will act on the advice given. Any associated costs of surrendering my dog plus the additional time spent at Hotel K plus $200 per week will be charged to me. I am also liable for any fees or citations from the local authorities for dog abandonment. Abandoned dog policy will go into effect three days after the end of this service agreement without any contact from me.
